Have you tried a mediation with a retired judge? If so, you could use a mock jury for that issue. Some sort of “objective” reaction would probably help the client see the light. Good luck!

Technically, the rules of ethics prohibit you from questioning them at trial if you know they’re going to lie. I’d withdraw rather risk an ethics complaint.

I led my firm in withdrawals….so I think you can guess my suggestion lol.

My natural instinct is to assume rejection if I have conflict with a partner or don’t think my feelings are reciprocated. I’ll try to bring it up with them, but I’ll say “if you want to end this feel free” so it doesn’t hurt me (and they can say what they really mean instead of sugarcoating). Someone told me today that they just assume I’m not interested because I always seem to “run” but I’m not sure how to bring up problems/feelings otherwise. How do you approach these hard questions?

If an employee mentions something disparaging or accusatory about their manager during an exit interview, how would you handle? What happens if what the employee said is slanderous and a “he said/she said” situation? If you opt to share the feedback with the manager, would the manager have a legal case against the company or former employee?

Need advice & perspectives: I got a verbal review from my manager saying he couldn’t see me as senior cuz I didn’t follow the design doc format he mandates from all designers. Also the product I’m on has been in MVP stage, things move extremely fast and design decisions changed constantly. He’s not on my team.

DE&I is now a core leadership competency. If you are managing diverse talent, it’s important to understand what the term “privilege” means within a DE&I context so you can lead your team to higher levels of inclusivity+develop optimal strategies for solutioning around team issues/challenges. Everyone has some aspect of privilege depending upon the context. Privilege means the absence of obstacles/barriers, not necessarily the presence of perks. Though some would say *that* itself is a perk.

Does anyone have any advice on how to deal with discrimination as an Asian in the workplace? In my company it seems like it’s a white boys club where and they just promote white ppl because they’re white. And then they have a lower bar for promotions for minorities (traditional minorities likes Hispanics and African Americans). Meanwhile they make Asians do all the work. I am not generalizing that this is how it is everywhere but it definitely is that way in my workplace. Any advice?

Completely and totally miserable at my firm and just need a space to vent because my friends are tired of hearing about it. I currently work at a small PI firm in Atlanta were EVERYTHING is settled presuit. If we’re unable to settle, then it’s referred to another firm for litigation. This whole process seems very atypical to me and the attorneys rarely touch a file until the first liability offer is received. The paralegals handle everything from intake to drafting the demands. The attorney briefly skims (does NOT read) the demand packages and signs. Is this ethical?? Anyone else work at a firm that is run this way??
