I’m at around 3500-4000 an OA response on average. Some bulk clients are a bit less. For new apps in electrical and software, I don’t go less than 17k.
Mostly AI and ML space with some med devices. It’s a challenge to find them, but there are clients out there who don’t view prosecution as a commodity to send to the lowest bidder.
I’m mechanical. I’d say most clients have a 10k budget for apps and a 5k budget for OA responses including interview. There are exceptional cases on either side of these ranges but this is a good baseline.
10-12k for apps; 3-4k for OA response (with an interview)
My former big law firm charged $5500 preferred and $6000 standard for an OA response. $18k preferred and $20k standard for new applications. I’m now a solo and charge $1500 for OA and $4k for application, but am still struggling to find clients willing to spend that much.
Based on hourly rates and billing requirements, while working in big law, I’ve gotten between $2k and $4k for a new application, and between $800 and $1600 for an OA response. Going solo, I just charge clients the $4k and $1.5k (higher end) that I would have gotten paid by the firm for the same thing.
Omnibus app: $20k+
Advanced app/more AI: $15-20
Mechanical/simple app: $10k
Quick and dirty provisional: $3-$5k
Cover sheet provisional: $1-2k
Strategic con (targeting competitor, etc.) $2-3k
OA with interview $3-4k
Strategic OA with considerations of targeting competitors, etc.: same or slightly higher
Simple OA with boilerplate arguments: $2400-$3000
OA where client provided arguments/claim amendments: $1400-$2400 based on level of involvement/review they expect from you
Pros budgets suck for a lot of reasons, one of them being that the hardest/most time consuming work is usually with solo inventors who can't afford to pay you that mhch

Damn, I need your clients. I am billing about 2000-2500 per OA response. My clients mostly have internal IP attorneys that usually provide helpful comments though.
If I am doing everything myself, then the cost can get up to about 3500. I rarely exceed 4000.
