I interviewed with Firm A months ago and accepted a position to start this upcoming fall. Group leader called me to offer the position back in November 2020. Besides interviewing with partners at the firms, and diligent follow ups notifying them of my interest to get started, no communication has transpired since.It turns out that I accepted a better offer w/ Firm B for personal reasons and won’t be going to Firm A. What is the best way to notify Firm A? Call/email group leader? Call/email HR?

Why would it not be legal?
It would not be legal because it is a gray area that can be debated in a court of law whether the person is rendering their services to you as an independent contractor or whether that person is acting as your employee in a W-2 capacity. That person can agreed to work as your assistant on a commission basis and then later turn around and sue you for wages and overtime because they should have been treated as a wage earning employee the entire time but they were just too stupid to realize it until later
It’s the exact same with every w2 advisor that earns commissions instead of hourly wages
