It is difficult to prove but if you feel as if you have been discriminated against based on being part of a protected class or if you feel your rights under ERISA have been violated. you can consult with an attorney for free but beware there are time limits to file with the EEOC. Good luck!

While my first gut reaction is to be appalled, I have to ask a couple of qualifying questions. You said "dropped me" and "this layoff", leading me to ask was it a termination or a layoff? These are specific and legal terms to determine what next steps are available to you to pursue.
First, you need to immediately get to your local employment security office to file a claim. They will be able to determine, directly from the company, what the circumstances of your lack of employment stem from. Then you can make a more informed decision to engage an attorney or let the department handle your workplace action.
Secondly, it is time to do an immediate and realistic assessment of your finances; savings, credit and resellables. Turn off anything that isn't food, housing, clothing and job search related, i.e. Netflix, AMC, Planet Fitness, etc. You have to know how long you're able to go with what you have left.
Thirdly, you have to assess yourself. Take care of your mental wellness. You did not do this to yourself. Hopefully, you are being honest with yourself. Network with your friends and family. This is not a time for shame or silence. You can apply for Social Security, if you haven't already. It may reduce your overall benefits, but it is your money with which to take advantage. 65 is a hard age to start job hunting, I know very well. You have to think survival mode for the time being. I wish you well.☮️💙
Remember to sign up for Medicare. Depending on what state you live in, there may be an employment Commission. Find out what your rights are.
Do you think with the current administration in our federal government there is going to be anyone left at the Dept of Labor or EEOC who is going to care or help you? Companies are going to realize the fox is guarding the hen house and the watchdogs are all laid off themselves really soon.

Not at all… these employers are cruel pricks.
It’s absolutely imperative to save for retirement as early as possible and the … get out of the workforce.
Sorry for your experience - I mean it when i say … I know your pain.
Thanks to everyone for your feedback. Just wanted to clarify that the reason I was laid off was to basically cut costs by replacing me with a resource from India. It was only possible because I had put in solid processes and governance which enabled my replacement.
Bigger question: Why are you still working at age 65? Do you enjoy working? How much longer were you intending to work?
Soooooo you’re ok with pushing someone out of their job due to their age because “After all, they’ve had forty years to prepare for this and if they want to work then they should take their slower selves to another employer!” Got it. I, on behalf of anyone in the workforce hope and pray you NEVER are in a position to make decisions on people and their livelihood. You will not be fair and open nor see value because you are too busy putting a timeline on peoples’ worth and contribution.
Appreciate your detailed response.
#1) was laid off as part of cost cutting and replaced with a resource from India who I had to train.
#2) very practical advise and I am already on it
#3) Have a solid network but the unanimous feedback is that at 65 the chances of landing a new job is practically ZERO. Applied to over 80 jobs which I rate my skills are at least 80% match, but rejection emails are swift.
Down in the threads, a couple of good comments: you cannot fight anything without a lawyer. And was anyone else laid off?
Unless I'm mistaken if you are older than 40yo (I think) they are supposed to give you a list of people who are impacted by the layoff (not names just titles and ages) of course whether you believe this info is debatable....anyhow when I was last impacted about 20yrs ago it's how California did it. Of course at that point I didn't care because I was also holding 5 other job offers and used the severance check for 2 weeks in Vegas. But a layoff at 65? After a good review? I'd hope the severance check was HUGE because they'd probably want a signed release. I'm not sure why they wouldn't just wait until you normally just retired?
What state are you in? How long have you been with the company? What was the reason given in you severance agreement? Certain states requires they provide you a letter that shows you that there were other people not over 40 that they laid off to confirm that this is not an age targeted lay off. Make sure you review your severance agreement to make sure all benefits you are entitled to are included. Most companies have different treatment if you were "involuntarility retired" which you will fall under since you are over 55. Again, some states provides better protections so might be worth consulting with a lawyer before signing your severance letter. Good luck.
Honestly it’s probably a quota. When they do layoffs they usually say it has to be x from this category, y from that category… HR doing the only thing they were hired to do and make sure the company doesn’t get sued. They have to throw in someone over 65 so they have the acceptable distribution. I’ve watched it all happen before my eyes. Sometimes it happens that your group might be a high performing group but the group has to pick one or more depending on the percentage of labor that has to go. Everybody doing their part. Most states are employer friendly and not employee friendly so they don’t need a reason especially if their distribution looks fair to the EOC.
They will easily justify and provide evidence against age being the reason (as long as there's no emails saying 'thia guys age, etc.) It's a waste of time but you have to go through the motions just in case some millennial put it in writing...
You are not the first and the way things are going- it will only get worse.
You are a victim of AI. Many companies slice and dice employees based on the capabilities and whether they can be replaced or not by AI.
I feel your pain I am a 57 year old man that has a solid job history and cannot get a call back from any of the jobs I have applied for.
