It is difficult to prove but if you feel as if you have been discriminated against based on being part of a protected class or if you feel your rights under ERISA have been violated. you can consult with an attorney for free but beware there are time limits to file with the EEOC. Good luck!

While my first gut reaction is to be appalled, I have to ask a couple of qualifying questions. You said "dropped me" and "this layoff", leading me to ask was it a termination or a layoff? These are specific and legal terms to determine what next steps are available to you to pursue.
First, you need to immediately get to your local employment security office to file a claim. They will be able to determine, directly from the company, what the circumstances of your lack of employment stem from. Then you can make a more informed decision to engage an attorney or let the department handle your workplace action.
Secondly, it is time to do an immediate and realistic assessment of your finances; savings, credit and resellables. Turn off anything that isn't food, housing, clothing and job search related, i.e. Netflix, AMC, Planet Fitness, etc. You have to know how long you're able to go with what you have left.
Thirdly, you have to assess yourself. Take care of your mental wellness. You did not do this to yourself. Hopefully, you are being honest with yourself. Network with your friends and family. This is not a time for shame or silence. You can apply for Social Security, if you haven't already. It may reduce your overall benefits, but it is your money with which to take advantage. 65 is a hard age to start job hunting, I know very well. You have to think survival mode for the time being. I wish you well.☮️💙
Remember to sign up for Medicare. Depending on what state you live in, there may be an employment Commission. Find out what your rights are.
Yep. Age discrimination.
Get use to it. Oh, and welcome to the real world.
And for the younger workers that think this happens only to other people? Wake up!
And as a scum master (intentional) I’d get ready to have your job replaced by AI pretty soon. Get used to it
Hire a lawyer and see
Chief
Was anyone else laid off at the same time?
Personally, I'd strongly encourage you to get a lawyer and see if age discrimination is plausible. If the attorney feels that it is then go forwards and expect some sort of settlement with a payout. It probably won't be an enormous sum of money or result in you getting your job back, but it's better than nothing while you search for a new job.
At will - except for a bunch of legally protected things like AGE. Sounds like discrimination. I’d consult an attorney. It’s in the business to prove that they didn’t fire you based on age. Keep receipts and write everything down.
DEI 2025...
Now there is no reason to keep or hire anyone based on previously established DEI guidelines...age, sex, race, religion, etc. Businesses and companies can now choose who they wish to hire or fire without having any backlash.
No one is no longer safe, It will become more difficult for everyone to have any kind of assurance, stability, or security for the likelihood that any employee will keep their jobs. Sad and scary times..
There are all sorts of ways for a company to whitewash discrimination and they typically target those who are least likely to fight back. Don’t share anything personal with anyone at the office. It will never help you but can significantly harm you.
Go in. Do your job. Leave after 8 hours. No ot. No special projects. No happy hours.
Director 1, that is not correct, they for sure know because they have to report the individuals age to someon, feds, state, idk. i saw the report when I got laid off!
When I was laid-off, my company also had to provide that report. I'm not sure if it was state or federal law. Anyway, age discrimination is tough to win. EEO doesn't give a lick about that.
2 WORDS, "AT WILL"
GOOD LUCK FOR YOUR FUTURE ENDEAVORS
Even in at-will states, they can't let you go/lay you off for an illegal reason (age discrimination). The trick is proving the real reason and for that, you need legal help. Make sure you have all your good performance documented. If they say they don't have to give a reason, that's not strictly true if you have reason to suspect you were let go for an illegal reason. Unless they fast-tracked a documented PIP and even then I think you have recourse, because they're going to have to prove that the reason they let you go was legal (performance, RIF, etc)
I would strongly urge you to seek immediate legal counsel on this! Do not speak with (former) employer until you do.
Likely they will engage the employer and demand an explanation and justification. Would also suggest you contact the department of Labor.
Outrageous. It’s sad they see no value in our rich level of experience and expertise! I’m now 67 and retired 18 months ago. Good luck!
If they didn't offer you any severance, I assume you did not sign anything that waived your ability to sue.
Consult a NELA lawyer - you have a strong case for suit. All sings point to excess privilege believing you are stupid and will accept this.
This screams age discrimination. Period
Everything everyone has said about "at will" is correct BUT you cannot, even in an "at will" state fire someone on the basis of age, sex or for retaliation. Call your state bar association and ask for a recommendation for a lawyer and talk to them. No it isn't easy to prove but it is not impossible. I was fired from a job with an email that was so stupid it made my case easy (you are doing a great job but we don't want a female in a director role)..

Dang!
Law suit if you can afford it.
Although many states are “at will”, you are in a protected class. You may have a legal case against your ex-employer, and you should contact a recommended employment-law attorney as soon as practical. The initial consultations are always no-charge, and you should be able to find an attorney that will take your case on a “contingency” basis where they will take some percentage of any monetary award (typically 30-50% but this varies according to the laws of your state). If you lose your case you owe the attorney nothing. But a contingency basis gives the attorney incentive to only accept a case they have confidence in winning AND to fight hard for you to get the award you deserve.
Welcome to my world. I'm being let go in a month and a half because the system I've worked on for the past 15 years is being outsourced. 4 months away from 65. No severance. Was told to find something elsewhere in the company. I work in IT, not on the production line making widgets. There are no other IT jobs open that I am qualified to do. Had planned on working until 67, but it's lower Social Security for me, I guess. No one will hire a 65 year old IT worker. They want the cheap 20 year olds, or the H1B holders from Asia.

😞
It’s a shame that’s what we work for all our lives. I took a 6 month early retirement and the hit that went along with it. While it forced a few lifestyle modifications; it was totally worth it. I too had no intention of retiring when I did. Wanted to work a lot least 2-3 more years. Upon reflection; it took me out of a stress filled workplace that never took me seriously; they simply tolerated me to check a box on operational requirements.
Trust me; if you’re good at what you do; there is plenty of side work to fill in the gaps. But then it’s on your terms, your time, and your pace.
Admittedly, I thought retirement would be a drag. But I’ve lost 60 pounds and rekindled my hobbies I have longed to be able to spend more time doing.
Sometimes a “blessing” comes hidden as a distraction and disruption to our lives.
Enjoy and rest in the satisfaction of a job well done and enjoy the rewards of life. It will be all right!
Blessings my friend!
Was anyone else laid off with you? Where you ever put on a PIP? Have you signed anything from HR yet?
