Contract clause where already disbursed money is returned
I’ve read those clawbacks aren’t enforceable, similar to non-competes... talk to a good lawyer and see what you can do.

I left before mine was up & nothing happened. I gave 4 weeks’ notice and kept expecting someone to bring it up after my 2nd to last paycheck was normal (the clawback would have exceeded my last paycheck) but no one did & so I didn’t either
Clawback sounds like a female-targeted version of Monster Energy. Or like a clapback so good it draws blood.
Wtf is a clawback. Sounds like life after my last agency.
Agency pays for relocation expenses but if you leave too early you have to pay back. Usually it’s 100% before six months and 50% before a full year.
No but I’m about to and I assumed they would take it out of my last check. I owe 50% based on how long I stayed.
I make sure language in my contract around relocation payback includes it being prorated for 12 months. eg if I leave in 6 months I pay 50% relocation back.
My sense is it tends to be discretionary as far as how or if they choose to enforce it. If you’re leaving on decent terms and there isn’t a sense you somehow wronged them, likely they won’t enforce it.
I think this is correct. I left on good terms (and actually off-hand mentioned it to my boss who just said not to say anything if HR didn’t mention it)
Random question I have: If I give notice right before the end of my clawback period, so that I leave a day after the year is up, do I still have to pay relocation expenses?
