Update - think I might have answered my own question but posting again here in case someone has more knowledge than my googling.... I have prior federal service (though have been separated from service for about 6 years) but I *think* that service makes me eligible for FMLA despite not being in the anticipated position for 12 months. The guidance I found said that 12 months of qualifying service at any time in the past makes me eligible.
You’re correct. It’s 12 months of Fed service to get FMLA.
Is this also true for former law clerks? I am a former law clerk and just started as an AUSA.
I went through the same issue and was told clerkship didn’t count, but I’d ask your agency anyway. Maybe they have a different interpretation
