If the agency has any affiliation with SAG/Aftra, using agency staff for talent is not gonna fly. And if the agency bills the client for photography, and you just keep getting your salary, you’re a chump

The agency is committing fraud by double billing your time. And by using agency staff for model talent, and then billing for that as well, they are not only committing fraud, but they’d better not be a signatory to SAG, or this is a breach of contract as well. My guess is they’re not. At any rate, you’re being screwed and you seem to all know it’s true.
They’re already being paid to be there. Why would they get more?
I think agencies should pay staff when they are using them for out of scope jobs. I feel I am getting used specially when It becomes the regular practice.
I mean, I’d love to have a photographer and be able to select them...if someone asked me, personally, to do the shoot- I could, but I’d feel uncomfortable, it would likely take longer, and probably not look as good as it could...but it would be fine. However, no AD is here to make “fine” work.
Yes, the agency bills the client for models and photographer and it is almost a regular practice. The situation is not very flattering and not everyone comfortable to do it but they fill obligated to do so.
What would be the right way to bring up the issues?
I know I am screwed. I am trying to educate myself on the topic. So any info will help. The agency is small also does production. They don’t have contract with SAG. I don’t know how they get away with it. I know for some clients they use this method as a discount offering to win new client or maintain the current one. I guess it works if you have a small agency...but it feels so wrong.
