How many billable hours should I be hitting with a motion for summary judgement oral argument prep? I’m an associate starting my second year practicing law. Any advice for oral argument? I am very familiar w/ the facts. But the partner just told me to handle it. It’s pretty much a straight negligence premises liability case. Any insight would help

You should do what it takes to be prepared. If your client has cost sensitivities, or the partner works prefer your limit your time, you should ask about that, but I'd never allow a time cutoff to keep me from being prepared to knock it out of the park and do the best for the client.

Bill all of the time you spend preparing, but be specific in your entries as to whether you’re reviewing briefing, reading case law, drafting an outline, etc. Don’t do a single entry for 4 hours of time that just says “Prepared for hearing.”

I’m not sure what you mean by the amount of hours you should be hitting? I’d bill as many hours at it takes you to prep and let your partners cut your time if they think it needs to be cut. In other words, just bill the amount of time you take to prep. Don’t worry if it’s too long. Good partners should understand it’s your first oral argument. Honestly, if it was handed to you either it’s a slam dunk or you have no chance at prevailing. If it’s the later, don’t sweat it (in my jurisdiction MSJ are pretty much always denied).

Agree with this. MSJs almost always denied in my JD. Plus, if you wrote this MSJ, then I’d think prep would be a little less than if you’d be starting from scratch. But try to balance not policing yourself on hours if you’re so early in your career vs. overdoing prep on something with a slim chance of success.

Have any of you taken "low bono" clients while working at a firm? I want to take on a low bono client or two but not sure who would get the money. This is a contract opportunity through a non profit so I'm assuming a 1099 will be issued. The per hour rate is significantly less than my billable rate. So I was a 5th year associate in nyc making 100 k a year 2k billable hours.. I decided to leave for the role Im in now.. my old countered to keep me at 115k (which was like pulling teeth for them) but I left anyways now I find out that they offered a 7th year 150 k and a partner title should I be offended that they didn’t even try more with me

I’m a first-time prospective lateral likely to get an offer shortly. I just received a lateral questionnaire that requests billable hours, rates, fees collected, etc. for the last three years. Forgive my ignorance but is this normal/standard? Do people actually answer these honestly? One of the reasons I’m leaving my firm is there isn’t enough work in my group so of course my hours are low.

1. Always ask dedicated budget for the job before you tell your expectations.

2. Always have atleast 2 weeks of gap before you join any company. You might not understand significance of that but just have a gap.

2nd year assoc. here. Finding myself spending 3-5 hours researching/analyzing issues that should only take 1-3 hours. I find myself questioning - for every assignment - is this the issue I was asked to look into? Did I read that case right? Does this analysis make sense? And I end up reading the same cases over and over. Does anyone have advice for being more confident/efficient on tasks, especially research?
