Treat OC like they're a person you're dating despite having no interest in them.
You accept that the firm wants to play by eternal gauntlet by fire, and treat them accordingly.
Don’t overextend yourself, and drag the cases out as long as possible, and grant zero extensions (if possible).
Misery loves company, keep moving forward and exhaust minimal mental resources. Sounds like you’re a newbie plaintiff attorney.
OP - sounds like this opposing counsel office takes everything personally. At the end of the day, this is business, not personal.
If you have a more senior attorney you can ask, see if they have any tips on how to respond in a nice way that basically shuts down how the opposing counsel is acting. It’s much easier said than done, but in the long run, you get more bees with honey than vinegar.
Just accept that everything you write to opposing counsel is something you are actually writing to the court since that's where it will end up anyway. Grant limited extensions so that you can keep the court on your side. Only respond to things that are important, not every little fight they want to pick. Save your energy and your client's money by focusing on what is important and not opposing counsel's nonsense.
If they build up a paper trial it's trial on the merits they file for summary dismissal, you lose. Build a big case. Be smart about everything you say, do and write though. Good luck and be well.
They have to file a complaint. Are you the owner? They can't move for sanctions, only for matters pertaining to procedure I'm almost sure. This post will go down miles but what I would say is get into a firm if you are not that proficient in law because that means you can't own and manage that well in law and they'll rough house you. I can tell you're not a super lawyer but you're a beautiful mind. They do it to good lawyers even. My support is get in with a pretty good firm don't take too many cases maybe three a year civil and get about 200,000 a year plus 20-25% from each case judgment. That's all. You stay you're a glutton for punishment. Dissolve the company. I think you can just end the company and fire them. The city may call for dissolution for a few bucks if you filed for company ownership with the city. Call them. If you promised to pay them yearly salaries file for chapter 11 Bankruptcy. Give all the reasons why you can't pay in whole or especially in part and explain in detail all the reasons why you need to start out new right now at a new firm on your own making your own money and not owing back into the firm with debt you can't afford and with people to you that don't need and don't deserve your time and expense. I have the same experience with a firm in my city that only employs Ivy educated lawyers and clearly teaches the master class on how to be an asshole litigator. It’s made extra frustrating by the fact many of these folks are excellent attorneys and have no need to be such colossal pricks. Regardless that’s their approach to every case and it has proven effective especially on the uninitiated. I’ve had at least one active litigation with this firm for the past decade plus. One of the few positives is that you know what you’re in for; full scale war. It took me years to abide by my simple advice - don’t let all the noise they’re making steal focus from what actually matters and only fight the battles necessary to win the war. I know it’s infuriating and stressful when you are against a litigation terrorist but I try my best to remember they’re really the only ones who believe their extreme actions are justified while the reasonable among us (including the Court) see their tactics for what they are. You have no obligation to these people to respond to late night emails etc. and I strongly encourage you not reward that type of behavior by sending a midnight response and engaging in every fight they pick. Instead consistently do everything possible to engage only when actually necessary on your terms and establish yourself as the adult in the room. Good luck to you.
