Attorney3 — I never said anything about “nationwide” (or even a “majority of states”). Instead I said “depending on jurisdiction.” Some large jurisdictions likely have laws prohibiting this. A4 just mentioned Massachusetts, for example.
Nor did I say anything about a law “requiring paid paternity or maternity leave.”
Rather, I said that providing maternity leave but not paternity leave was potentially unlawful sex discrimination. Also, for example, NYC human rights law prohibits disparate impact discrimination, including on the basis of sexual orientation. This policy might run afoul of that.
My firm gives 3 months paid paternity and maternity leave which can be used at any time during the first 12 months after having the baby.
