If a right arm is injured in an accident, and the left arm is subsequently injured due to overcompensation and over use of the left arm while the right arm was immobile, is the negligent party liable for the left arm injury even if it was not directly related? In Work comp, I believe they cover these kind of overcompensation injuries. But I am not sure of they do in PI.

What’s a good LA or NY business litigation firm and salary to expect? How do “commissions” on top of base salary typically work for pre-litigation associate compensation?

As a former Corporate Counsel, now mostly solo practitioner in Federal Court specialty practice is a mixture of Bankruptcy, Immigration, Business Transactions and Employment law.

I am finishing up my second year of practice as a lawyer. I transitioned to plaintiffs pi work from a boutique commercial litigation firm. I like the work and not having to bill. The issue I am having is managing volume. I have about 150 active files some pre-lit and the rest are in litigation. Cases range in value from very small to low six figures. I also take the driver seat for the grunt work on the firms bigger cases which are at or near 7 figure value. I constantly feel (cont.)

What's your preference for plaintiff's side? Steady pay at approximately $120k with no bonuses, or a base salary of $70k plus a cut of what you close over a minimum threashold? Midwest-ish market. In both situations, you get a cut of what you bring in.

Has anyone ever dealt with Geico UM case where they insist that a release needs to be signed? Geico extended our client’s policy limits but wants him to sign a release. We offered to sign an acknowledgment of receipt of funds but Geico said without a release signed, they will not issue payment.

I'm a 6th year attorney in NYC. I’ve done PI work my entire career for over 10 years. I’ve worked in state and federal courts and I’ve traveled around the country doing MDL work and bellwether trials. I’ve had a lot of success making the idiots I’ve worked for wealthy, but I’m still waiting for a moment where I enjoy what I’m doing. I feel stuck working in dysfunctional plaintiff firms/cultures. I hate this profession/career more and more each year. Has anybody been successful breaking off on their own in recent years? Advice?

I received a job offer from a PI firm (MVA and tractor trailer cases) in Houston, Texas; the bonus proposed was 2.5% of attorney’s fees for any cases settled each quarter. We are assigned 50 cases a quarter and the top attorney clears $25K each quarter. This is my first time working at a PI firm. Can anyone share any guidance? Is 2.5% industry standard? Is it realistic to settle/resolve that many cases? I am trying to learn more about this niche before I counter-offer and attempt to negotiate.
