Bird in hand vs in bush ... based on what I am seeing most of my friends doing , almost all of them are going for downgrade
Rising Star
Why wouldn't you? There is no downside to trying as a denial has no consequences for you, but an approval gets you an EAD and AP.
Ofcourse, it is alternatively possible that due to everyone else doing the downgrade, your EB2 moves faster and you get a green card faster. But if I were in your shoes, I will apply, get the EAD and AP and enjoy the freedom it affords
Talk to a lawyer, a friend of mine who has said that you get to keep both the i140s as neither is revoked. So if eb2 moves you can use that date.
Rising Star
Yes. If EB3 moves, EB2 must also move. That’s weird.
Rising Star
No I am suggesting stuck with EB2.
Rising Star
Wait. EB2 is current for all categories. What’s your nationality?
Indian...sorry forgot to mention in my post
Rising Star
Here you go.
Rising Star
Unless you are Indian, it means your priority date has been reached. You can file for a GC right now.
Chief
Fairly certain OP is Indian so their EB2 isn't current and he / she is wondering if it is worth it to move to EB3 and file
