Newbie RE attorney question - if a commercial lease provides an option to renew for x years, and the tenant exercises the option (timely and in accordance with lease), does the LL have any leverage to change unrelated terms for the renewal period? Client exercised option and LL is insisting they sign a new lease that is mostly the same but changes some key provisions (like percentage of operating costs attributable to client). My instinct is no, but interested to hear other perspectives.

I have a real estate client who at the top of his organization chart owns is 50/50 partners in a real estate investment company. First question is it advantageous to have the top of the organization 50/50 partners own the r/e company as an s-corp? general question, about how long after submitting an online application should one assume that they aren’t getting an interview?

My natural instinct is to assume rejection if I have conflict with a partner or don’t think my feelings are reciprocated. I’ll try to bring it up with them, but I’ll say “if you want to end this feel free” so it doesn’t hurt me (and they can say what they really mean instead of sugarcoating). Client, layperson, may have agreed orally to a settlement amount without proof of damages prior to filing appearance and obtaining an attorney. Client filed appearance pro se, then plaintiff sent over a draft settlement agreement few weeks later which client didn’t sign. Client then got an attorney, filed answer, etc. Can this oral agreement be voided for coercion, indefinite mat’l term, etc?
