Smaller successful plaintiff’s litigation firm in small/mid size market. Firm owner is proposing to decrease salaries in roughly 2-3% increments over the next few years and increase contingency fee split bonuses in a defined tiered structure that tops out at ~10% of fee recovered. Currently bonuses are discretionary but are usually 10-30% of base. Problem is the defined structure isn’t really any better in exchange for the decreased base and risk. Any suggestions of alternative proposals?

It might not be bad depending on your case load, what the split is on cases you bring in, and what your average case result is.

At my firm my associate pay starts at 120k base + 5% off the attorneys fees on the cases they resolve & 1/3 of attorney’s fees for cases originated. Base pay & percentage will go up from there based on experience, case results, etc. SoCal firm, HCOL.
