Any of my Pennsylvania colleagues had any luck defeating a timely invoked and pretty well written intentional act exclusion to an insurance policy? Big policy limits and girl’s gotta pay her rent!

Just don’t plead an intentional act and trigger it

Excellent thought, thank you! Underlying conduct is an assault, so a bit of a challenge to frame it that way.

I have one pro bono case that I kept when I left my firm to go in house. It’s a matter completely unrelated to my company and I have malpractice insurance through the nonprofit organization associated with the case. I’ve made clear to my client that I’m repping this client in my personal capacity. No one has asked me specifically about pro bono stuff at my company - if I know there’s no conflict of interest, is this something I should disclose? To whom should I disclose this?

One of my senior managers is a boomerang and told me she was laid off when she was 7 months pregnant about 10 years ago. I think she was a senior or manager. She was in a specific group and everybody was laid off. It wasn’t performance based.

Would you work at your company again if you were laid off?

4th year at a mid size PI firm. Got pulled from litigating MVAs to help this solo we hired start a med Mal/nursing home practice. 1 year in and it looks like I’m two steps backwards in terms of getting paid because we’re a year or more out from a lot of the fees hitting. I’ve done PI work my entire career for over 10 years. I’ve worked in state and federal courts and I’ve traveled around the country doing MDL work and bellwether trials. I’ve had a lot of success making the idiots I’ve worked for wealthy, but I’m still waiting for a moment where I enjoy what I’m doing. I feel stuck working in dysfunctional plaintiff firms/cultures. What's your preference for plaintiff's side? Steady pay at approximately $120k with no bonuses, or a base salary of $70k plus a cut of what you close over a minimum threashold? Midwest-ish market. In both situations, you get a cut of what you bring in.

In house or M&A/Real Estate Transactional are likely the end goal but want to get the litigation out of me first.

In an auto accident trial, can you inform the jury in any way that the at-fault driver had insurance? I currently work at a small PI firm in Atlanta were EVERYTHING is settled presuit. If we’re unable to settle, then it’s referred to another firm for litigation. This whole process seems very atypical to me and the attorneys rarely touch a file until the first liability offer is received. The paralegals handle everything from intake to drafting the demands. The attorney briefly skims (does NOT read) the demand packages and signs. Is this ethical?? Anyone else work at a firm that is run this way??
