Did anyone become barred in NJ by motion? If so, I have two questions when it comes to the ‘prior practice’ requirement:
- does the period between taking the bar and being admitted count towards the 5 years of prior practice? I started working in Sept. 2022 and was admitted to the NY bar in April 2023.
- does maternity leave count towards the 5 years of prior practice?
Thank you!

Motion based on what? if first bar admission, period starts with the date of admission ie. the date when you took oath/signed I believe.

like

Motion based on the fact I practiced law in NY for 5 years and I’m barred in NY.

I actually got in touch with the NJ bar. They said that the period I started working at a law firm post-bar but not yet admitted counts as part of the 5 years. Similarly, maternity leave does not impact the 5 years timeline either as long as I was employed and in good standing.

like

Makes senses since some people in NY pass the bar but cannot take the oath for several months.

like

DC once again emphasized day one took the oath.

like

It counts “lawful practice” I believe. So I don’t believe periods where you’re not admitted would count. As for maternity leave, that’s a good question.

No if you weren’t doing lawyer work. Re: maternity leave if you were employed it should count.
