Have a new colleague (fairly junior) who often claims that any hours we work past 5pm should be paid at overtime. This colleague always signs off right at 5 (not been a huge issue as we have are in a more relaxed phase) - but has voiced that they don’t intend to work past 5pm because we are only paid to work 40 hours.

I believe that the hours we are expected to work are understood from the start and that our high compensation reflects the longer hours we often have to work.

No sharepoint, we use teams but can’t share files on it, only for IMs and calls. An MD has to approve and pay out of the group’s budget for us to even create a channel in teams. The DMV probably uses better technology than us

Assuming you’re a salaried professional (which most consultants are) you’re not getting paid for 40 hours, you’re getting paid for getting the work done — which takes as long as it takes. Your colleague is going to get fired in a hurry when things get busier.

Things aren’t necessarily mutually exclusive. This person is within their rights to set boundaries and I do agree with them.

However, the employer is also within their rights to say this person isn’t getting the job done and let them go. It really just depends on the company culture.

I think the thought “we get paid more, so we work more” is a dumb excuse that’s been fed to everyone by senior leaders as a cop out. There’s more to the job than just the hours, it usually takes a higher aptitude for your given role, as well as just general stress that warrants higher salaries.

I can guarantee a lot of hours worked over 40 are wasted fluff that doesn’t actually move the needle except on the invoice.

That’s fine, but either they or the company can reach the conclusion that this is not a fit for them and part ways one way or another. It’s not really your prerogative or role to police them, so worrying about it is a moot point.

I 100% support this junior colleagues actions, so long as they step up to the plate in an emergency. If they are still talking about logging off at 5pm when clearly sh*t has hit the fan (because of factors outside of control not just bad management), then that’s a bad teammate

There’s been a few times where I get deliverables later than I requested.

I generally send out all items for the week on Monday morning and it rarely changes from there. So it’s on the team member to get it done by said time (and I’m pretty good about giving enough time).

I don’t send requests at weird hours and I give fair deadlines - in the few instances where he hasn’t met them it is cause of his 5pm rule.

I’m all about WLB….but this is a joke. Why get into consulting knowing the WLB? They are gonna have a rough time.

If your role is exempt from overtime, then you work until the job is done, which could be more or less than 40 hours. If your colleague wants overtime, s/he should look for a role that is non-exempt.

I appreciate everyone’s insight. I think the necessary context is that our firm has great culture and generally our work weeks are between 35-45 hours a week. And about 10% of the time we have a week that goes to 50-55 hours and about 5% of the time we have a 60 hour week.

He gets paid $130k 2YOE to do this.

Companies and people are different and have different expectations. This has to be aligned and has to work for both sides. Usually, individuals can adapt quicker to companies’ needs than the opposite.
I would suggest aligning expectations with this colleague before he actually needs to work past 5. If he doesn’t accept it, he may be better off elsewhere

Lol that’s not what OP is talking about. OP - rightly so - is saying he/she doesn’t want to get stuck with the bill when this “team” member doesn’t want to show up. Consulting is a team sport in my opinion - you don’t want to support the team - there’s the door.

It is a fair mindset, if he is not able to finish his work in the assigned 40hrs then it is a performance issue

If other associates are willing work 60 hrs to get the work done and you leave 1/3 unfinished because you are only willing to work 40, are you going to accept a salary that is 2/3s of the other associates? If the last person that didn't get the job is willing to take your current pay and bust their tail to get the work that the work done, should the company for you and hire them?
