The Maternity Benefit Act 1961 states that a woman should have worked with her employer for at least 80 days in the 12 months preceding the date of her expected delivery.
So you can join Capgemini and complete 80 working days and then go for maternity leave.
I guess that 80 days should be 12 months preceding the date of her expected delivery
congratulations 🎉
.
Be careful with capgemini, in some projects they will ask you to give resignation (soft layoffs) or move you to bench if you ask for maternity leave within few months of joining
Performance issues were there, but still doing layoffs during that time is not a humanity thing, they should have waited till their maternity completes and given then layoffs,
Ya, it's convenient to take ML in your existing company. But I have heard that situation in Cognizant is not good. People are asked to voluntarily resign. I heard this from 2 friends working there with fear and you can see the same trend in CTS bowl itself.
I wud suggest stay wherever u r . Get ur ml period done, then switch as u will get some extra leaves which u need too..then bang on.. switch
I would suggest you to first discuss with the Capgemini HR and give them a clear understanding of the current situation. Also, ask them to check with the respective reporting team manager for which you have been selected, whether it is possible and manageable at their end considering the same. If they are fine with it then drop a formal email to them initially and document it. Else, stay there wherever you are!
Also the struggle doesn't end here generally the first year is crucial for baby care and also at work place so you can make it clear else stay in your present company.
Its better to take resignation back and take ML in the current orgn rather than in CG...
Else it will cause inconvenience to both you and Capgemini...
Is it possible to discuss with Capgemini HR. Also think about the extra bucks that would be helpful for you. Also it would be unethical if they fire you. You are not the only one right, many would have gone through similar situations. I have seen supportive people as well. All the best!!!
You need to work a minimum period in an organisation to avail maternity benefits. Big companies waive off that period as well. But service companies like Capgemini do not waive off. Talk to the hiring manager, put everything in email. They cannot withdraw the offer as it’s against the law.
Legally they can't fire you once you apply for ML, but if they notice it in advance and want to fire you before ML then law of land doesn't stop them as of now ...just go through govt rules for the same, they'll have to follow them
Hi, I was also in this same situation couple of months back. So, In my opinion if you feel like capgemini's offer is better than current one please go with that. You will get all maternity benefits if you work for 80 calender days in an organization in India.
Take your resignation back.
i would suggest you to take back your resignation and start looking for new jobs once you come back from ML. Anyways I dont think its a good time to join Capg looking at the current market scenario.
Don't make conclusions on your own. Give it a try at least if it suffices both CG and your requirements then both of you will be in win-win situation.
you can request to get WFH instead of ML. 9th month you take Loss of Pay leave.
Man. That’s a clear cut violation of law. They cannot even withdraw the offer now. Educate yourself.
Take your paper back. It's time to redeem relationship you maintained with your current employer.
Could you please share what happened when you informed Capgemini about your pregnancy?
Can you please share what happened?
As I have similar situation with CG.
Did you discuss with CG HR?
In a similar situation. Please let me know what did you do and how did it go.
Hi, currently i am at same phase. Have you joined Capgemini?
If you are in a project by that time.. you can expect maternity leave. If you are in bench, they will make you resign.
