This is a question for the agency, for them to answer in writing. I am guessing they'd try to say she's not eligible for the severance since she's working; I say this because most agencies' severance packages these days are actually 'bridge pay,' not severance, which is valid only when the person isn't working. It sucks.
I know people are tempted to say yes to these asks, but if you do I hope you charge a real freelance rate, not the equivalent of your old salary. If an agency isn't going to give you benefits, pay employer/employee taxes, etc. they should have to pay you extra for that. I feel like agencies think they can just lay off FTEs and then hire them back at a discount, with no consequences.

It might make sense to ask them to hire her back as freelance/contract worker? Plus pay her severance etc.
Sounds like they need her so she has negotiating power.
