Question for the more senior people. I’m roughly 20 years out of law school. Been at a v10 since I finished my clerkship. I will be moving on during the next year. I’ve done lit my whole career with no specific focus (I’ve done everything from antitrust to securities to bankruptcy, etc). Trial work, tons of depos, appeals, etc. I’ve spent the past year looking for an in house position with no luck. I haven’t wanted to go to another firm but may not have a choice. (Cont’d)

I totally get where you’re coming from on trials and especially discovery. I turn 57 next week. The last big jury trial I first chaired was a few months before COVID hit. It was a brutal multi week jury trial that was really complicated and very high risk - the kind of case that I loved ten years ago but just don’t have the energy for now. As I walked out of the courtroom after giving my closing, I told one of my partners that I was done first chairing trials. He laughed, but in the time since has become convinced that I was dead serious. Since then, I have shifted to a training role, but I also consult on trial strategy and supervise youngsters handling smaller commercial cases and pro bono cases. I’m also open to playing the evil opposition at mock trials and other jury research exercises and taking a few crosses or picking a jury in a trial led by others, so long as I don’t have to drive the bus. Is there any possibility that you could work out that sort of set of responsibilities with your current firm, even if it meant reducing your pay?

I love(d) trying cases. Lots of pressure and sleep deprivation but I couldn’t get enough of the creative side of the job, especially jury research and the graphic design process. Retiring from life in the ring was a lot like retiring from team sports, which I played collegiately and at a pretty high recreational level until I was 50. In both cases my body just couldn’t do what it once did and I didn’t want to be the guy who played one year too long. I also really like teaching, so the transition was kind of like moving from playing a sport to coaching.

I’d explore with your firm the viability of an altered role. I work 66% time, am paid 66% of my last base share level, and have time to do what I like, which includes teaching law school classes as an adjunct and the stuff mentioned above. I and the firm both get a good deal. Hopefully your people will feel the same way.

Issue is that I really don’t want to do more trial work, discovery, etc. As in really really don’t. Would stick an ice pick through my eye before I did another large trial. Forget about discovery. Hence why I was looking in house. Has anyone ever made a transition this late from in court litigator to things like investigations or other non-litigation areas? How realistic is that? And I don’t have a real client base to bring along. This is NYC.

Can you name a firm (preferably NY office) that lets its associates work from a different country with no issues? The mid-size firm I’m currently at has been very flexible during covid but I’m looking to change firm (biglaw). Since my family is abroad I find it extremely valuable to be able to do this (I did this even before covid for a couple of weeks, twice a year).
