@VPD1, no, there is no legally mandated paternity leave in the US. Anything you get is a voluntary benefit that comes with at-will employment
I’ve been laid off twice, both times within a week or so of finally getting business cards. 🤷♂️
Here’s a news flash: this business sucks. It used to be great. Now its full of ass clowns who don’t do the good work. They just flap their jaws in meetings. Get out while you can. I loved it, but that was then, the fat days ....And now? It’s ugly and full of blowhards and charlatans. Work on the client side. It’s less sexy by a mile, but stable.
Clients know how to make money . Today’s agencies don’t. They’re the walking dead.

This sucks but A. Your ECD or group director should have given you a heads up you because they had the conversation about letting you go months ago. B. This industry is struggling lots of talent will be let go. AORs and MSAs are hard to come by.
Exact same scenario happened to me, too, as an Sr AE. But I knew they had layoffs while I was, I just didn't know if I was on the list.. found out by 9:45am on the Monday I went back in.
Two friends of mine (a team) got laid off while one was one week into a 4 week holiday. His partner said he’d break the news to him when he got back so as not to ruin his holiday. Problem was, he got the return dates wrong and his partner turned up for work without the slightest clue he had been let go three weeks earlier.

How does some get laid off during paternity leave? If that happened your friend should find a lawyer.
I just don’t understand why the industry standard can’t be, “Hey, let me level with you. Business is bad. We’re broke. In 3 months, we’re going to have to let you go. You know we love you, so this really sucks. Start looking for a gig now and we’ll be flexible with your interview needs and give you great references.” (I mean, from the business side, I know why they do it the way they do, but on a human level it just blows so bad.)
I’ve seen layoffs happen to people out on maternity. If it’s a “job elimination” then it’s allowed
Layoffs are a pretty long process. It was def not because of your vacation. They happen months before, and a lot of higher ups are briefed usually at minimum a week in advance so they can adjust the teams.
I've been at places where they knew for several months who was going and when. They just hold it close so no one panics. Sometimes they leak it, so people will leave on their own. I've litteraly worked for weeks staring into the face of people that knew and just pretended all was good, nothing to worry about.
The business isn't cold, it's the people are generally just agentic shit. I get it you got kids and a mortgage, but yeah... history is full of whole contries doing terrible shit, and when questioned they were all like "well I have a family and I was just following the party line." Karma is a mean motherfucker, and no one is irreplaceable.

@CD3 — I thought the same but from what he said the agency didn’t want anyone to know when it was coming (which is standard) and by keeping them from shooting, it would be obvious. Granted everyone knew layoffs were in the air but b/c they were on the shoot, they figured they were safe. 20 other creatives got cut too.
Guy I worked with, was called at home during paternity leave and let go. He did live far and the story was they did to save him in the trip. Still sucks
At least you got your vacation. My agency did not pay my days of vacation when I left.
