Thinking about accepting a software engineering offer for BCG Digital Ventures . can anyone working there tell me about the work culture, learning opportunities, and exit opps . Im also interviewing with Zillow and am deciding wether to wait or take an offer. So she's been having performance issues for 2+ years? She's lucky she hasn't been fired yet. Being pregnant and a woman of color don't protect you from being fired for cause, but most won't touch that landmine because of the exact insinuations you're making.
Edit to add: keeping obviously low performing employees around does nothing to advance the cause of diversity, in fact it can get in the way - because colleagues can see when someone isn't pulling their weight, and if they look around and see obviously underperforming people who are being sheltered because of their "diversity", that undermines everything diversity initiatives work for.

We can’t lower the bar just because somebody is a person of color. Long term disability / maternity exist for the other issues.
Is the employee covered under any FMLA protections during this time? She may want to consider this asap.

She would’ve had to request FMLA to be covered, and she’d have to have a documented accommodation plan in place for that to be a factor. If she thought she could just “tough it out” and not ask for any accommodations, she’s probably SOL, unfortunately.
Well, I think employers, especially large ones claiming diversity and wellbeing, should consider her circumstances... The color doesn't change much, however a pregnancy, heavy procedures, and chemo are big circumstances... The firing feels unethical... I think it's worth researching if she has a basis to sue the company.
If she’s been a poor performer for over 2 years then it was prior to being pregnant and chemo. She’s lucky that the company was so busy and they weren’t really letting people go. Her race and gender have nothing to do with her performance and the fact thats what you want to focus on is ridiculous.
Her best option is an LOA or FMLA. They can still let her go but it at least puts her in a little safer position.
Tell her to contact the @mamattorney on Instagram if she’s in the US. @pregnantthenscrewed if in the UK.

People who think the everything is racist will always find racism in every situation and use it as an excuse to not think critically. Recommend you adjust this approach. You are implying in your post that this colleague’s poor performance is due to pregnancy and chemo, which is likely very possible and sad, but you are also implying it is due to her being a woman of color, which is actually quite racist on your part for bringing this into the equation.

Seems like the opposite, OP is implying she should be protected because of those characteristics and that it would be wrong to fire her since she's a woman, pregnant, and of color...
