Colleges have always have vaccine requirements, this is not new. I don’t think it’ll be the norm for employers
Right on BCG1, colleges requiring vaxs is nothing new. They have always required a bunch of vaxs, or proof of immunity there of.
The focused attention ergo should be on employers requiring vaxes, which has not been traditional in the corporate space. (Admittedly there were plenty of jobs pre-Covid which required various vaxes)
There are people who can’t get the vaccine and it think it’s a slippery slope to having an ADA issue.
^agree, this scenario could be argued as non permissible discrimination, there is enough jurisprudence to support, in my opinion as there are clear reasonable accommodations available beyond what was offered. If I was hypo firm’s gen counsel, I would advise that reasonable accommodation would include affording a test to Joe so that the firm does mitigate the risk of bringing someone on who could not only spread covid to the firm member but to the client as well.
Now if Joe refused this test, and cannot get vaccinated, there is jurisprudence that could be use to argue that the firm performed allowable discrimination under the ADA in order to mitigate an undue burden (increased risk of outbreak to the business and to the client).
I think employers should position the ask this way:
Employees are subject to daily/weekly/periodic negative Covid test results upon entering the office which is waivable upon furnishing proof of vaccination.
This way you are not messaging forced vaccination upon anyone yet taking steps to mitigate liability of being an outbreak cell during the still ongoing pandemic.
It is, but a law suit for wrongful death is more expensive. Also the firm will likely be required to have an accommodation for those who cannot be vaccinated such as testing due to the ADA.
Besides many small enterprises have weekly testing regimes, I do not think the large professional services firms can use cost as an undue burden to be relieved of ADA requirements.

Plenty of our projects are at hospitals that require consultants to get specific vaccinations and boosters that you probably wouldn’t otherwise, and no one I’ve seen has ever batted an eye at that, nor have I seen a fuss over it on the news or social media (such as fishbowl). Now that vaccines are politicized, everyone feels compelled to argue about my body my choice which is so strange. Where were you when you wanted to live in a college dorm? Would you have said no thanks to a booster shot required for a client and been rolled off? Where was this outcry then?
I don’t think any company will require it, but I know some companies have started giving you a few hundred dollars for getting vaccinated, and a few hours of pto to go and get it
