Give it all to the spouse. I don't even need to read the rest.
OP, she must of hit a lottery when she married you. Hire an attorney and start the process of fixing this. Don't give her a single dollar more than court allows, of course offer her a fair amount to settle / walk away but sounds like you got a hell of a fight coming. Next time use your head before marrying.
OP what kind of trash did you marry?
So she kicked you out of the house you paid for and wants your portion of the refund? Give her the refund and have police arrest her for trespassing on your property
Your phone have a voice memo feature? Use it to record her. My god, get some balls dude. Kick the freeloading bitch and her family out of your house.
Unfortunately law favors women more than men . She can easily claim anything she wants
No
Sorry you're in this situation OP
I'll say just this. There are state by state laws that determine asset splitting (tax refunds are assets), alimony and child support. In many states, the latter are formulas up to a certain amount of income, after which it's raw negotiation. The answer to this question will be clear to your lawyer, who you will need FUCKING RIGHT NOW YOU STUPID ASSHOLE! Sorry, that was me yelling at my former self, not you. Seriously, your ex is playing hardball and you need a lawyer. A former client of mine, thrice married, said that he tried one divorce friendly and got screwed AND the ex was still not happy. He did the second one tough as nails, then after the settlement went more or less the way he hoped, he gifted her some stuff as a gesture of reconciliation and they are now friends. Hell hath no fury like a woman scorned as the bard said. And behavioral psychology backs up his move.
We are separated but my spouse asked to file jointly and said just need the part of the return based on her w2 only and nothing from my. Now after filing she wants 50% of my refund as well since we filed jointly and I got the extra refund because of that
Kids? House? How much is the refund? Just make it fair and move on.
I can't imagine being married and managing money like this...seems like a recipe for a slow growing disaster
No kid , have a house . I pay all the bills and mortgage but she lives there. I am renting. Refund is around 12k , I gave her return based on her w2 now she became greedy and harassing me every day with calls n emails asking the money, even her family
I moved out because she is difficult to live with and was about to make a fake Domestic violence complaint against me. Being fed up of all this I packed my bag and left. Now even her mom lives in our house with her
I wish I could have kicked her out but legally I can't since she doesn't have a degree and dependent on me
What law is that a legal requirement? It's your house. Divorce her
Filed for divorce but she is not signing since she want to stay here and once we get divorce she will have to go back so is dragging the case
Why are you not divorced? This is a no brainer.
That's fine, you can have a court order the divorce. It just takes longer, how long has it been since filing?
