I'm just here to say I am so sorry OP. As a native born American I am ashamed of what is happening. Best wishes on everything.
I’m so sorry to hear this OP. It’s been a common theme recently. One possible way I can help is we are always looking for good talent in the NZ firm and visas tend to be much easier to secure. If you’re looking for a bit of a life change we are a small but mighty member firm. Flick me a note at lfoster@deloitte.co.nz if this is of interest to you or anyone else you know in this situation.
D12 if your application was rejected, how is your visa up next year? What application was denied last year? Did you reapply and get it approved until next year?
@M5 I tried transferring from an L1 to H1, but was unsuccessful and so I can work till the end of my L
Never had a problem before with this. EY files for multiple locations together. Many/most of the times there will be an EY office in the client city. I'm sure same is true with D.
You need to ask for denial reason.
They actually did admit (to a certain extent) that they shouldn't have listed it as another reporting office. They did not tie it to a client travel requirement....they clearly call out reporting office vs. Locations travelled to for client service
Right... What I meant is, check the reason that USCIS gave.
Tried but this is all I got...even that was a chore. Either way, they are refilling and nothing can be influenced 😊
Hmm... Did you try a consult with a 3rd party lawyer like Shiela Murphy?
Cyrus?
Goood luck OP.
The same. GGS preparing app for refile. Have completed conversations with all Deloitte immigration and business groups though, and the options in case of denial aren't too bad...
Side note, have started having conversations with a bunch of acquaintances at D since denial on their story and realized that the denials are kind of random and not a norm. Met someone on Friday who joined the firm and same offering around the time I did 6 years back, background even more suspect since he had done his masters in an unrelated field and worked at a small unknown firm for couple of years prior to D, and spent 3 years as a C and now 3rd year as SC. He had been held back 2 years ago in india for 4 months due to stamping issues requiring further Admin checks. Applied for his h1 on sep 6 and got an approval in 6 days, alongside wifes ead (another clause I did not have). I have also been staffed 100% compared to him.
Guess it's just luck ....
Stating the above to alleviate fears others have.
OP visa denials are not a refoection of the individuals qualifications, its about how good a job the firm has done in explaining your role is specialized
That's the thing, he is a really good friend (2 of us know each other since kindergarden) and he shared his app submitted...they were almost identical with mine having 2-3 additional bullets with managerial responsibilities. Seems like they use a generic job description which is standard across levels vs. one you submit / draft ....
There was nothing else in the whole app which talks about responsibility and most of it was common. GGS submits a pretty lean app (20 odd pages) vs. Fragomen who used to submit 100+ pages which included everything.
Anyway, just some of my observations. Guess the managerial responsibilities were a deterrent...but what to do ... not get promoted indefinitely..
You can appel the case again, it’s not end of it
Hi OP, I know it’s been a while. Following up on your situation. Did you hear back anything?
Very interested as well. Am responding to an RFE, and the law firm has asked me to provide more details on the original job description.
No. Still waiting. I looked at the app they filed on Nov 7 and they have requested a premium process, but yet to get a response since there is still a hold on PP through Feb.
RFE!!! Should I be concerned it is just a step by USCIS prior to a denial?
Obviously, reason for RFE wont be shared ...
I also got an RFE. I resubmitted a very detailed (think 2 pages from the initial 10 bullets) job description contextualized for the client. Waiting for a response.
I received an RFE. I was asked for my offer letter from 8 years ago, and pay stubs. Finally my H-1B extension was approved, but only for 1 year.
Thanks! This is helpful to know!
