Nobody asked, and I would have given a hard no. Totally off market for lateral recruitment. (Maybe less so for in-house recruitment, since firms generally like their associates to be recruited in-house.) If a lateral recruiter had even asked for such a thing, I would have seriously considered withdrawing from the process because it shows that the recruiter or the firm doesn’t have the right attitude on confidentiality.
I’m a legal recruiter and I totally agree with A1 above. Firms do not and should not ask for a reference from your current employer. If you have someone who can attest to your work who is not at the firm and you 100% trust, perhaps give that person. If the “application” or questionnaire asks, put “to be provided at a later date.”
Oh I dealt with this. Just talk to recruitment and tell them you need to let the firm know before they call anyone. Assuming you have a good relationship with your references, take them aside and let them know they will be getting a call. Don’t announce anything until you know the conversations went well and you’re prepared to give notice.
The request wasn't specifically for my then-current firm, but my references included a partner I had worked with that had lateralled to another firm not long before me.
I had to give 3 references from my old employer, but I asked them not to call any of my references until conflicts/background cleared and I gave my 2 weeks notice. They were ok with that.
