I dint think visa gets affected by in same los career progression it will impact if profile is changed or los changes , but good to confirm with firm’s attorney
My LOS changed because assurance moved to advisory. They said no action needed
Hi, this exact situation happened to me. There's no issue and no refilling. The only consideration you should have is the process is faster when you're a manager eb1 vs eb3. So if you're getting promoted in the next 8 months it might be better to wait
Exactly
I asked the same question to our mobility and said that it needs to be refiled. You can check again to verify w/ your lawyers.
Earlier I was told there won’t be any issue and then the immigration team changed and as per the new team, for such cases or any change in the role and responsibilities will lead to filling new PWD.
Chief
As long as your perm and i-140 are approved then you can get promoted as many times as possible without having to restart the process from scratch.
I went through the same situation, my I 140 and PERM was approved when I was an SC. I had to begin from scratch after I got promoted to M but the priority date was ported so no change to that. At that time it was GG law and they mentioned my job description has significantly changed due to promo so have to file a new PERM, so had to go through that painful process again…
Check with Talent and BAL since it's best to get your individual case analyzed . But most probably if your effective promotion date is after PERM is filed, you should be okay. but if you get promoted before the PERM is filed, D will ask you to refile the case.
Talk to your immigration attorney. Mine told me that as long as your PERM has been approved and it’s a promotion with equal or greater responsibilities then you are OK. I went from Associate to (non equity) partner during GC process (after PERM) and was fine.
