I cannot guarantee they don’t look at things like that, however…it is illegal and a sure fire way to face a lawsuit all the while destroying a company.
Unless there is a smoking gun, I would not place much stock in this. Just focus on caring for your family and doing your best work.
That is pretty common. Especially for a small shop in which a dedicated Benefits team is not available. You will see an HR Leader and their team able to see the data for the purpose of plan administration. Claims-level data “can” be accessed, but it is terrible practice. Those instances should be limited to those in which an employee comes forward with a concern and wants help. Usually, that involves the EOBs. But that is getting deep into the weeds.
It also depends on your company's arrangement. If they are really small, they might have a fully insured plan sponsored by the insurance company. This means the company pays a premium, and the risk is on the insurance company (and they usually have some form of reinsurance).
Larger firms are self-funded, which means the claims the insurance company pay are funded by the employer. It's up to the employer to potentially get reinsurance and determine how claims history impact the premiums from employees.
