Must have a distributable event to rollover 401k assets, unless part of the 401k balance was itself a rollover into the plan. Employment status change to PT does not constitute a distributable event. Termination of employment does.

Under the SECURE Act depending on how many consecutive months and how many hours they could likely still be considered eligible and if there isn’t a provision in the plan document they could be prevented from doing so.

I’d say do a review of the plan document with the tpa.

3 years ago I asked for a compensation review/raise, went through what felt like a ridiculous 8 MONTH long process of defending why it was warranted, only to be told no. 3 months ago I asked again and it has gone nowhere. Edward Jones advisor with 30 million AUM and roughly 250k gross production. Been there for almost 4 years. Got an offer at Merrill Lynch to take over a 100 million dollar retirement transition plan in 5 years, or to join a 5 person Merrill Lynch team that manages a lot.

Pros to EJ: Have my own office, a year or two away from partnership, great office setting and client satisfaction.

Pros to Merrill: Bump in compensation, additional tools and services w banking, ability to take over assets.
