You definitely need to raise your retainer and make sure your clients understand that it is neither a guarantee or an estimate of what their case will cost.
Sounds like your typical family law case 😅 I’m usually relieved when I get fired by a client like that. It happens. But definitely raise your retainer. A $3k or even $5k retainer is perfectly acceptable for a family law case.
I made the mistake of taking low fees when starting. Don’t do it! You get way more respect taking a 5k retainer to start
Higher retainers weed out these types of clients too
And a 5k retainer is consisered low in a contintious custody dispute
I won’t take a case without a $10,000 retainer … fewer cases, but MUCH better payment percentages!!! Value yourself !!!!😉
And stepmom kept calling me for 30-45 minutes multiple times a day. The retainer was nearly exhausted because of all the phone calls and emails. Then the dad (actually my client) fired me because I told him the retainer was almost gone and he got pissed nothing had happened in the case. Nothing happened because it’s a new case and I was trying to work out some temporary orders with OC. First time being fired by a client so I’m a little irritated by the lack of cooperation and my inability to handle my client and his unreasonable expectations. A learning experience for sure!
My contract clearly states that the retainer is not a flat fee and not an estimation of what the case costs. It’s just to get me started in the case.
I’m newly solo. Before this, I clerked. I needed money and clients which is why my retainer was so low for some of those initial cases. Also, the folks that have been contacting me are from more rural parts of the area and they don’t have money for an attorney.
This was a good learning experience but these people were literal nightmare clients. I wasn’t even hired for 10 days and they expected orders to be entered by the court. It’s just hilarious because the dad has other children and has been through the process before. Just not sure what he thought I could do to move it along more than what I was doing (negotiating with OC).
