Left Bain for an offer at a small tech company, and it took the new employer a month of pushing my start date, poor communication, and “internal discussion” to pull the offer because they think my US work visa is too risky for them, despite immigration lawyers backing me saying there’s virtually no risk. I’m now out of a job and on my visa grace period due to their incompetence (bullet dodged).

Any advice on potential actions besides jumping back into recruiting? Feeling quite disrespected 😫

Sigh. Always make sure your visa transfer is confirmed before putting in the papers at your existing job.

Re: next steps, not much you can do. You could try to sue, but that’s going to need a lot of your money and time, but the reward could be worth it. Would consult a lawyer.

Speak to a lawyer to see if there are serious grounds to sue. If so, call back the employer and explain that you will sue if that's where it gets to but that you want to keep it amicable and you're still very much wanting to work there if they are willing to make it work. Not the best of starts but you need the visa more than settlement money.
Otherwise if Bain will take you back that's also a good option before jumping into recruiting (maybe after a while...). Would try to connect with your highest relationship there and have them support you through the transition.

Another option I haven’t seen mentioned is to find a lawyer to write a strongly written letter and look for some sort of cash “settlement”. Decent chance the company would just cough up some money to have you go away and helps offset your lost income while continuing your job search.

I definitely wouldn’t want to work there at this point though, even if they agreed to bring you on... sounds like a shitty employer. Would be nice to drag some money out of them though.

If you’re on good terms with Bain, would also pass along the intel to whoever so they can blacklist the company for future alum exits.

You should have no issues going back to Bain or any other competitor firm. It’s just difficult that your 60 day period is during the holidays and a pandemic. I’d say, get back in touch with your old team if you left on good terms

Could be promissory estoppel, but employment is at will in most of the US so I don’t think you have any grounds to stand on. It’s not uncommon to have offers withdrawn, sadly.

Never resign before H1B transfer is approved. You don't have many options, try the Global Immigration bowl for some advice. Your only true option is to get back into recruitment or you'll have to move to B2 visa after your 60 days grace expires.

Been for a company for over 2years. The executive team is very much a boy's club. There are a few women in management roles but zero ethnicity diversity there. I raised my concern to HR in feb.
