NY court just ordered all employees fired for being unvaccinated to be reinstated and given back pay. The court heard arguments and declared that no evidence showed that the vaccine prevented transmission or contracting the virus. Not giving my opinion just reporting the facts. What do you all think?

This is absolutely the right thing to do. Despite the insistence by the media several months ago that getting the vaccine would absolutely prevent contraction and transmission of covid, we now know that to be 100% false. Moreover, we now know that natural immunity is every bit as effective (likely more) than vaccine immunity. So firing these people for not getting a vaccine that doesn't do what its manufacturers and proponents claim it does is criminal. BTW I'm not an anti-vaxxer. Vaxxed and boosted because I felt it was the right thing for me and my family to do. But it's insane to me that the crowd that rallies against government intervention in healthcare when it comes to abortion is the same group demanding covid vaccine mandates and socialized healthcare.

These people were mandated by their *employer*, who happened to be a government entity. That is completely different than a government entity mandating for every single person within its jurisdiction e.g., state abortion laws.

My understanding was the vaccine helped to prevent severe symptoms. Nothing more, nothing less.

I would note that this is just one judge's opinion. It's the New York Supreme Court, but the NY Supreme Court is their trial-level court. Unlike what many might think given the name, there are two levels of courts above this in New York, the Appellate Division and the Court of Appeals. If it gets to the latter of those, it could be appealed to the SCOTUS.

In short, this is one judge's opinion and there's still a very long road ahead before anything is finalized.

Also worth noting the judge is a republican. I read the decision and the tone and reasoning sounded very in line with what we've heard from republicans.

Lastly, the judge's opinion on how a virus and vaccine works is just their opinion.

The judge said the city rule was unfair to those workers when other professionals were given more freedom to get vaccinated or not. Below is an excerpt from the opinion

“There is nothing in the record to support the rationality of keeping a vaccination mandate for public employees, while vacating the mandate for private sector employees or creating a carveout for certain professions, like athletes, artists and performers. This is clearly an arbitrary and capricious action because we are dealing with identical unvaccinated people being treated differently by the same administrative agency”

So judge is not disregarding effectiveness of the vaccines or vaccine’s effectiveness. A judge cannot opine on medical facts, they issue judgement on conduct of the agency. You are not reporting the fact, you are reporting your opinions. In simple words, a judge cannot pass judgment on if you somebody is really stupid and selfish …but they adjudicated if that behavior was within the law.

The judge actually did talk about vaccine effectiveness, which was really surprising to me. In his conclusion, he states, "Being vaccinated does not prevent an individual from contracting or transmitting Covid-19." He goes on to say the Covid vaccine "isn't absolute", that breakthroughs happen, that President Biden said the pandemic is over, etc.

The judge says he isn't commenting on effectiveness, but that's what the above sounds like to me. To me, his opinion sounds right in line with the republican agenda and the judge happens to be a republican.

I'm doubtful it will be held up on appeal.

Supreme Court already ruled those types of terminations legal, so the appeals court will overturn the flawed ruling.

I believe requiring employees be vaccinated is 100% within an employers right and even responsibility and employment is at will in any case they don’t need a reason to terminate.

I think that private employers can make their own policies even if they don’t make sense, so long as they don’t discriminate against a protected class otherwise break laws.

I don’t know if the case was for public employees or all employees, but unless there’s a legitimate discrimination claim that was ruled upon, this seems like a very bizarre role for a judge to play.
