People thinking H1B is what is replacing them is hilarious. H1B are at the same risk of being laid off so firms can hire more offshore workers

Because those jobs are going to foreign workers. US companies need to first employ US citizens. H1B should only be extreme exception cases where talent in the US cannot fill the role.

Why would that ever be tolerated, in any civilized country?! Let alone one like the U.S. which is one of the top economies in the world and has a high percentage of college educated adults.
PM1 , I agree. There are 2 options where unfortunately these % of abuse happens. 1. Those positions will never be open in US as those work are already being done from offshore through consulting firm ( where this type of abuse mostly happen). 2. They will use the minimum wage structure of existing flawed visa system and pay comparatively low wage to bring that person to US under H1B.
I would still prefer option 2 as it improves our economy and there is a high possibility that due to numerous reasons ( such as visa expiration, Company switching, homesickness etc) that position might open abruptly to US workers ( possibly at higher wage) as the firm may not get enough time to replace it with another H1B.
So, its a win-win .
If that was the case then 75% of h1b hires wouldnt come from A SINGLE COUNTRY. over 85% comes from two countries. That is ridiculous. We need population adjusted country caps in h1b visas to ensure we are truly grabbing the best and brightest across the planet.
If they arent here because "they're cheap", then 100k should be a drop in the bucket.
I didn't pull the numbers out of thin air. I used the gov data but wanted to show some further research that was done on top of it which is why those org sources were cited.

In 3 years from 2016 to 2019 , it increased around 50K. By that estimate, between 2019 and 2025, it should increase around 100K even though during 3 years of Covid , it actually reduced. But, lets consider the worst and add 100K. So, around 720K which is what I mentioned.
Now, stack that against total workforce with Bachelor's or some type of college degree.
Some College Degree : 33.9M
Bachelor’s + Degree : 63.2M
Total: 97M

Being on H1B I can tell:
some are hired because they are cheap and convenient
many are not cheap but very convenient for employers.
Almost all of them would come under “convenience” tag from perspective of employers.
TC1 I did say explaining it well. There is a lack of verbosity with explanations. The explanations are very succinct for clients and the management of clients is very to the point. Despite the amount of detail that’s undergone in multiple projects.
From what I’ve seen. The whole passport issue and how much H1Bs have to do to stay or keep sponsors is beyond the wage slave power employers have over national citizens. People say it’s more work for less for the employers. But it also looks like to me a stronger position of power over their employees from the company side.
It’s always crazy how people default to blaming the h1b people as if they were the ones who structured the program, set wages, passed any relevant laws, or started hiring. If you’re angry, look upwards.

Cheap or convenient, it’s abusive when a significant portion of this visa allocation is taken by staff augmentation firms masquerading as consulting or tech.
When corporations buy these temp resources, it looks more like colonialism than capitalism

H1B should be even more expensive. Should be half a million at least (I’d argue even a million). The only H1Bs that should be given out is for talent that would make the US worse off by not having. If that isn’t the case then companies need to hire people already in the US.
