You accepted the terms of the bonus when you accepted the cash. The condition was you’d have to repay if you left the firm within a period of time. It’s your obligation and responsibility to repay it.

I am a manager with EY and I had someone do this to me/EY. Our legal department told me that this is our policy.

We don’t send to collections. You can get away with it but that doesn’t make it right.

Again, EY does NOT send these things to collections. But to answer your question, a judgment is most definitely not needed to use a collection agency!!

KPMG1 I’m sure you can imagine some breathless news story about how big bad firm is going after a guy whose house is about to be foreclosed upon. The average Joe doesn’t appreciate a ‘clawback’ and why we have one!
EY 4, how have you come to the knowledge that the firm does not pursue collection? I’m not sure I’d be counting on that.

Sadly, the nuances you explain (and up to debate as OP never stated his new employer is paying it) are not the issue. Further, I never commented that I agree with not pursuing. Please check your facts before launching ad hominem attacks!

EY 4, I am not being ugly with you. I am directly and literally asking you what it is that you do that endows you with this knowledge, since you are so insistent. Without providing any sort of information about how you came to this knowledge, which you have repeated multiple times on this thread, my caution to OP (who I think is scum) is to not trust your advice. The worst advice I’ve ever taken in my life was a unqualified “trust me.” I would never suggest a person do that. You are not presenting yourself well, so since you’re not the thief why don’t you take a step back and answer what was an earnest and straightforward question: how do you know that the firm would not pursue the amount owed?
