Also not a lawyer but my understanding is that a person cannot be fired *because* they are pregnant (discriminatory), but that they can be fired *while* they are pregnant (due to performance issues). Work still needs to be done properly so if you’re struggling with that due to factors outside your control, consider having a convo with your manager/leadership (and maybe HR) to reset expectations temporarily. Having expectations you can live with in writing could protect you - and your sanity - too.
I’m not a lawyer but anything emailed and the fact they have set up weekly calls can be used as evidence that they tried to “help” you improve. Ymmv but it’s mostly there to cover the company’s ass. I would start job hunting if i were you
Generally, I believe you can still be fired WHILE you’re pregnant. You cannot be fired BECAUSE you’re pregnant. Employers have some requirements to allow accommodations, but you have to request them. It’s illegal for your employer to make accommodations without you requesting them (i.e., take it easy on the pregnant lady cause they think you can’t handle it).
Congrats on the upcoming arrival! Have you told them that you’re pregnant and that you may need some special accommodations (nausea, doctors appointments, limiting travel etc). My experience is that you tend to get a more human response when your manager knows why you may not be performing quite up to the pace you have in the past. If you don’t get more understanding from your manager - is a LOA a possibility?
You’re a protected class so rest easy. They most likely will not fire you. But just in case that happens make sure you document everything and then sue them. You’ll have an easy case.
100% agree around the “reasonable accommodations”. But if she can prove that the accommodations are not right for her and her pregnancy then she has a case. Worst case scenario she settles and takes home a nice check and can sit back and be home for a few years without having to work.
