I’m surprised the agency kept doing work for this client after a full quarter of non-payment.
And how has the brand been running media without their media agency noticing?
Shitty client behavior to be sure, but I’m curious how it was allowed to last this long.
In terms of what would I do? Get the lawyers on the horn and see how exclusive the engagement was, demand payment in full and if they don’t deliver, sue em.
Truly - you need to have a word with your finance department before you lose your job for their mistake.
Red alert 🚨 time to get that money or pencils down.
I’d have gone pencils down after 100 days of non-payment. Assuming your account and senior leadership have inquired and sent the usual reminders then I’d get CFO or CEO on the phone to them immediately and demand payment. Scrape the MSA first to ensure you know the terms for everything including exit.
I realize this is the bane of a creative's existence but does your agency have a good project management system that flags issues such as this one so that work halts until finance clears it?
