Can change the beneficiary to another child, no cost or penalty
529 plans are owned by the participant, not the beneficiary. You can change the beneficiary with no penalty.
This is in regards of a 529 plan.

Penalty may be waived...but taxes usually have to be paid. You may be able to get away by assigning a different beneficiary...Please check the latest as law change constantly...

My thoughts are that the 10% penalty would be waived due to the circumstances. It is so difficult to find this information on the IRS website. According to the Internet the penalty would be waived. According to the 529 provider nothing is waived (however, my feeling was that the provider was unsure).
I do understand that the 529 beneficiary can be changed with no fees but in my friends case there is no one he can name beneficiary. Parents are older and educated. No cousins or family members around that need an educational plan. This is so frustrating.

If this is a 529, the beneficiary is not actually the owner. So, custodian can assign a new beneficiary. If an IRA, would assume it could go into an inherited IRA. If the parent is over 59 1/2 then no penalty should occur, just normal income tax on any withdrawals.

Inherited IRA’s never have a penalty even if the bene is under 59 1/2.
