It’s likely a violation of your contract if it involves any ad work. Just read your contract carefully. Large agencies don’t write friendly contracts.
After reading both contracts the part time contract allows any other form or work as long as it is without conflict and my full time contract only mentions issues when work is for “a competitor of the company’s client” but nothing about freelance/vs part time.
Get it in writing that your CD and new employer are aware and on board. Without that legally you won’t be protected because CD could “forget” the conversation. That said, knowing you’re not 100% committed to your company means you’re also likely first on the chopping block later
This! I was on the chopping block come lay offs because my boss knew I was having coffee chats with CDs at other companies. I wasn't even actively looking to jump just learning/networking.
Also, I think it is easy for people to assume you're not doing your best work for the company due to the other commitment even if you are prioritizing your full time work and doing great.
“Uncertain times”. Get your money. Don’t trust the agency. Make moves that benefit you.
Part time - no, freelance - yes
I would check your contract with your current employer. CD might say it’s fine, but HR might have other thoughts.

Check the employment agreement you signed upon being hired. You signed one. Promise. You don’t want to give an employer a reason to let you go in this environment (if you breach an agreement you won’t be eligible for unemployment). That said, even if an agreement is in place, your employer might support the side gig if no major conflicts.
Assume there will be conflicts. Take the new job. Your agency will probably be grateful because your salary will save them laying off others. You might even seem like a hero to them. Plus you doubled your money!
My contract with the agency I am at says I cannot do design work for a competing agency, along with all the issues of doing work for a company that could be a competitor to a client I am already working for.
Be mindful of expectations at both places -contractual and otherwise.
