It’s not unfair, it’s the company’s policy and they can make whatever rules they want. The 12 month marker is common for most internal policies because it matches up with FMLA and state leave.
You could always ask to see if there could be an exception for you with a claw back clause. Meaning they’d pay you while on leave but then if you left the company within the year you’d have to pay the money back. This is not common but it’s worth a shot to ask.
