Very new family law practitioner. First family law proceeding today and judge ruled in favor of third party intervenor. Feeling so upset and defeated for my client who has worked so hard. Any tips for me? Also, opposing counsel is really loony and seems unstable/uses weird bullying antics. I am always very calm.

I’m not from an English speaking country but I am watching a tv show and businessmen walk into a room and instead of greeting eachother, everyone says each person’s first name in lieu of hi, however in my experience working in the states, I haven’t seen anyone do this, it’s always hi or good afternoon or some other greeting first THEN they say their first name. is it also appropriate to omit the greeting?

Has anyone else had a mentor (assigned to them by the Company) who seemed to have it out for you? I mean downright sabotage to make you look bad left and right. I didn’t realize it at first. She was fake friendly, but she was discrete too. Some of the executives thought she was amazing, but I had to clean up her work all the time. She wasn’t above me either on the chain of command. Later I found out she had tried for the exec assistant role and they didn’t choose her, they wanted me instead.

Anyone else get frustrated when the partner brags about their billable hour amount for the month? Like congrats, you get to bill .2 for each piece of mail. You also get .2 for every letter your secretary types up as a "form letter" you never even look at. As an Associate, I don't get those easy/automatic hours.

I think there should be more males caretakers in this world. Some of my clients just feel more comfortable with a guy and it's kind of sad how often they say I'm the only male they could find.

T-14 and big law have placed me in the company of some really accomplished individuals. It likely skewed the bar in terms of what I find as impressive.

In my company it seems like it’s a white boys club where and they just promote white ppl because they’re white. Pivoting from five years of insurance defense litigation at a mid-size firm to family law in a small/boutique firm (3 partners and about 4 associates). How does everyone bill for family law matters? Do you always bill hourly or is there some flat fee, monthly or quarterly fee structure that could work, even in contested matters? I have cases that the clients end up spending $20-$40,000 on a contested divorce and this is really out of their budget. I feel that if my firm could charge a flat fee of $10-$15,000, it would still be beneficial from a client predictability and volume standpoint and would generate more referrals.

What days does your firm close for the holidays? Are you all working on January 2nd?

(I don't want to be a task master, but as an associate, I was expected to work a half day on the 24th, and a half day on the 31st. I'm closing the office 23rd and 26th this year, but currently listed as open on Jan. 2nd).

I’m a second year associate at a small, but reputable firm. My caseload is almost entirely made up of clients who were referred to one of the partners but the partners are too busy so I end up taking the case. The clients are told up front that an associate, rather than a partner will be taking his/her case. Working on a divorce where the father is claiming that he is unemployed because of the previous administration’s actions with DACA (he was brought to the States as a child). I know that the memo rescinding DACA was ultimately vacated—but OC is unsure whether this would count as voluntary unemployment for child support purposes. I believe it does as the application period to renew DACA benefits was reopened in 2020. Thoughts?

A relative is raising a teenage son with her ex-husband. They have joint physical custody. The ex-husband has re-married. When the son is in his care, he often leaves the son at home in California with his (new) wife when he travels for work (which is often). The relative wants her ex-husband to leave their son in her care when he travels out of town but the ex-husband disagrees. The relative wants to know her chances of prevailing if she were to appear in court on this issue. Thoughts? Thanks!

In OAH the NCP has submitted no actual earnings only hand written sched c (Uber). NCP lied under oath about how pmt for the car was made. Said a friend paid for it and he is paying a friend back. I have bank evidence that shows every car pmt came from NCP Bank and only deposits were from Uber. Problem is the car was paid off in 2018 and the CSO was from 2018. CP asked 4 mod and it was brought up to ? his credibility. How do I get it in since its not about $ now? Judge granted 1wk 4 adtl exhibits

My client wants both parties to list assets & liabilities as an exhibit to their prenup without values, but waive the right to know the actual valuation of those in the prenup itself. My initial thought is this is a terrible idea & would probably make the prenup easily voidable since a main requirement for a prenup is for both to understand the nature and value of the other’s assets. I will research in my jurisdiction to confirm, but has anyone ever heard of/done this? Thoughts?

Small firm (my boss, me, & a paralegal). After a hearing I did not handle, boss intended to seek review of the ruling in its entirety. What was communicated to me by paralegal was to seek review of a portion.

Seeking review is now time-barred. Boss is not upset, but this is 1 case & 1 problem. There are other cases & other stories.

How do I talk to my boss about being more present (boss is never in office, has “too many” emails, never answers his phone) without being seen as insubordinate?
