Whatever off-the-books law the clerk out in the state comes up with the day you try to record something in their county.

Lol. Love this. I had a document that had to be recorded in multiple counties and one recorder put their recorder information sticker over the information from the other county, then said they didn’t do that and never would, then admitted they did and told me they could do whatever they want. (There was tons of space for the second recorder to put their sticker elsewhere)

My personal favorite is in GA, it is the only state to have “year’s support” for RE.

Originally created to protect widows and orphans, it is a probate action which can convey title for RE to a surviving spouse (or minor children) and also excuse property taxes for a year. I’ve seen year’s support used to also creatively avoid bad security deeds (mortgages) and other non-perfected real property liens

I’m seeing lots of posts about really bad losses. If you trade you’re going to lose money - hopefully not all the time, but many positions will be mistakes. But you need a process to find ideas and manage positions. Two books you should read are “The New Trading for a Livinng” and “The Laws of Trading.” Both look at psychology, process, and risk in different ways that can help you work out your own process. The next 18 months will be much harder than the last 18 - time to start learning.

Pro se plaintiff, an attorney, filed a complaint alleging mold defects after closing on a property. Client, layperson, may have agreed orally to a settlement amount without proof of damages prior to filing appearance and obtaining an attorney. Client filed appearance pro se, then plaintiff sent over a draft settlement agreement few weeks later which client didn’t sign. Client then got an attorney, filed answer, etc. Can this oral agreement be voided for coercion, indefinite mat’l term, etc?

Any advice on shifting from association law to commercial real estate in FL?

I've been applying to jobs for months but every position wants at least 2yrs of experience in real estate transactions, usually way more. I'm at 1yr+ doing HOA/condo work but have had no opportunity to do real estate transactions like I expected. Seems like the only way to get the experience is to have nailed a big law gig right out of school and get put into that practice.

Do you review the other side’s escrow instructions and provide comments? 4 years in and I’ve never done this. Working for a new partner and she insists on doing so “in case there are competing instructions” but isn’t that the entire point of funding through an escrow agent/title company?

Has anyone ever heard of this type of real estate private equity fund structure:

-One LLC, so only one PPM
-Multiple investors that can be onboarded anytime
-Multiple investments that investors can determine whether or not they want to invest in
-One K-1 per investor based on their investments and income
-Ability for the Sponsor/Fund to invest directly, indirectly and in equity, debt, Pref, etc.
To me this seems extremely cumbersome and would require multiple classes of (cont’d)

Do you charge a flat fee for representing a buyer in a straightforward purchase and sale of one property? What’s ballpark legal fee — from LOI to PSA to diligence to closing? Assume pretty clean title, maybe one CC&R.
