I’m at Ogletree. The perceptions we do a lot of EPLI hasn’t been my experience at all. I have zero EPLI cases right now, and usually have between zero and three on my desk at any given time. We do a lot of advice and counsel which isn’t usually covered by insurance and plenty of clients are huge companies that self insure or pay their own bills.
Regarding caseload generally, I typically have about 10 active matters and 10 that are dormant for one reason or another, plus day to day advising. The workload is very manageable in my experience. 1900 hours required, I aim for more.
A mix of class actions, single plaintiff discrim, trade secret/noncompete, and internal investigations.
Jackson Lewis is probably the only one of the big 4 where you're likely to have mostly EPLI.
As a comparison, I work for a non-big 4 firm that does trade in EPLI mostly, and I have about 30 files in active litigation and another 15 that are dormant.
I think it feels like a foot to the chest every day, and that I can't spend the time I need to to actually strategize and settle things - just trying to keep my nostrils above the water line.
But I'm told that it's pretty light and if I want to make partner one day I should try to keep a case load of closer to 40+ active files.
(I do not want to make partner)
Previously at one of those firms and had around 10 active matters as well. It was usually 1-2 EPLI, but it depends on who you work for. Matters were a mix of discriminarion and W&H, but that will also depend on who you work for and where your interests lie. Also around 1/3rd advice work by the time I moved in house. Ofc as a newer associate to the firm (usually regardless of level) you are just taking whatever they give you for a while unless you come in with niche expertise.
