I would say it really depends. Like I have a disability according to the standards set, but they don’t affect my job so I’ll never disclose them to my job.
Not a lawyer but it doesn’t offer job protection beyond anyone without disability. I also believe the only way they can get rid of someone for having the disability is if a reasonable accommodation is impossible to make. As an example of an (minor) accommodation, I received an ergonomic keyboard due to carpal tunnel. I have other accommodations as well. I think, though, you need to talk to an employment lawyer.
Do you need or anticipate an accomodation?
Reporting the disability allows for the accomodation.
But it does not exempt you from firing or layoffs, as long as that action is demonstrated to be based on other factors (eg you committed fraud, you were arrested for a crime that makes it impossible to work in your industry, the company laid off 10% of the workforce)
Can the company let go due to the disability?
You should notify your employer ASAP through the proper channels so HR can review.
Talk to a lawyer first. I think it could go either way.
If you don’t need special accommodations, don’t report it
I have a disability and had it before starting at Pepsi. I was originally hired as a remote employee.
I tried to get disability accommodation to stay remote with their return to office mandate of 3 days a week, because traveling/commuting is difficult. HR replied that the building is accessible and refused my request 😐
I will say I quite enjoy emailing HR 3 times a week to complain the ADA door buttons are shut off, and I can't exit the elevator lobby due to being unable to open the door 😆 I usually sit in the lobby area for about 15 minutes before someone else can hold the door open for me to get through.
Thank you everyone for your responses
This is kind of not great but even if you do have a disability (and I do as well), companies will find a way to terminate you or lay you off that has nothing to do with your status if they want you gone. There are so many ways to let someone go without touching Title II or IX. eek.
Can they let go because of disability? If the disability has a negative effect on the quality of work?
