That would be a major red flag to me. The fact that the company still employees him is another red flag.
Clearly it bothers you or you wouldn't be asking. Follow your gut. Otherwise you may have difficulty trusting your new CFO - which could be miserable.

If you feel like you work for unethical people just be careful. If stuff goes down your license could still be at stake
Definitely would be a factor for what it was for. The number on reason people lose their cpa is for failure to file a tax return.
Meh - sometimes people get pissed off at others and file claims. Wouldn't disqualify him immediately. I assume you talked to him during interview - what kind of vibes did he give off?

Your gut already told you the answer. You are an ethical person if you were already looking for dirt on your future boss. You know you don't want to work for them. Let this job go.
