I understand trial skills are honed by doing. However, where did you all start trying to hone your litigation skills? As a solo and law firm owner, where would one get this sort of guidance.

Observing. If you’re able to or know anyone who is on trial, I would highly highly recommend going and observing. You can pick up a lot about style and procedure just by sitting there (including what you like and may want to borrow, or what you didn’t think worked all that well)! Helped me build up the confidence a lot when it was my turn to do what I had already watched another attorney do.

It depends where you are! Some circuits will have copies available for request at the clerks office for things like injunctions, dependency or criminal cases as they always record those. Civil-wise I would guess that the trial attorney would’ve had to request a digital court reporter to record everything so they may be rarer to come by

I hear fantastic things about NITA from some great trial lawyers both young and old who say it made them the lawyer they are today. If you can go to one of their in person trainings/trial academies I hear they’re fantastic

First year lit associate here. I had a tough time deciding between corporate and lit and chose lit because I wanted to litigate. Its only been a few months but I’m not enjoying the people or the work as it turns out (too many internal investigations and researching obscure issues, haven’t been on a single filed case yet). Advice for Of Counsel roles? I am of counsel at a firm where I can set my own rate and keep a percentage of collections, which varies slightly depending on whether the client is one I generated or not. I’m finding that a lot of my work is for firm clients where the lawyer negotiated a flat fee (and the hours worked are less, due to efficiency etc). We are a firm of 5 transactional attorneys and the bonus structure is very unclear. The usual “based on personal performance and firm profitability” language. I wonder how this is calculated in general. What is the percentage bracket of the bonus? Assume it is a high performance 9+ year attorney and the firm is profitable (even with COVID).
