Recently came back from leave (needed a break due to stress and burn out) and employer was great about it, letting me take as long as needed (over 3 months). They were very supportive - so I came back. But I’m remembering why I needed leave in the first place - nonstop work, loss of enjoyment of life because I was expected to work 6 days a week, and constant stress/exhaustion. Only been back for a week but worried it’ll go back to how it was before. Advice on whether it’s time to leave? (Contd)

I was in a similar situation recently - took 3 months leave for stress and burn out, and tbh general trauma due to working with a particularly toxic person. I didn’t return as others have gone off on stress/left and the culture did not change a bit and I did not want to risk my mental health by being back in that experience. Sometimes I think back and don’t remember it being so bad, but then I review my journal entries and realize it really was awful and I owe it to myself not to be miserable. You’ve had the chance to try again and remember why you left in the first place so you’re in a great position to decide whether you want to keep at it or not. I don’t think the fact that they were accommodating is relevant especially if the culture was so bad as to require you to take time off. Do what’s right for you.

I took medical leave for mental health and my psychiatrist told me at the time she didn’t see a way where I didn’t regress right back if I stayed in the same job, so I used the leave to look for a new job. So much better now in ever way!

Mine told me and my employer that, under no circumstances would I be returning to the firm.

I also came back because I felt like I owed it to them since they were so accommodating. But nothing seems to have changed with work culture/workload. Advice?

It may seem obvious, but in my experience partners value trial experience over anything else, so get it however you can. For example, my firm will favor a former prosecutor who has seen the courtroom a lot but has no civil litigation experience (not even a depo) over a seasoned associate who has only second chaired cases with a partner but hasn’t tried a case. Even trying a case and losing gives you credibility at my firm because you still did it.

Does anyone work at a firm where legal assistants don't do legal assistant things? For example, I have to do my scheduling and calendaring. I have to upload documents to our file management system. This morning, a name partners assistant didn't realize the name partner had a depo and didn't confirm it. This is how this firm as been for decades and it's incredibly frustrating to work this way. It's so hard to not stress over this daily.

I have a partner who routinely ignores emails or responds to them several weeks later. He has to approve every single document sent to the client or the court, which means you have a physically go to his office to ask him to review something. I work in a firm that is known for litigation defense. I’ve been developing my own plaintiffs practice as well. I am able to pay the bills with my hourly defense work, which gives me time to focus on a handful of high value PI case a year on contingency.
