I am in the unique position of being a severely underworked big law associate. I am a second year in an Appellate practice who cannot seem to get any billable work. Any advice for getting experience when you are in a small department with a mid level who hoards all the workflow?

I would meet with the partners and maybe reach out to other groups and let them know you have capacity (or if that’s not acceptable at your firm, reach out to someone who can reach out to other groups). There may be other groups at your firm they are dying of too much work so maybe you can cross train. Or if your firm gives billable credit for pro bono work (mine gives 50%) you can do more of that.

I was having a similar issue and decided to leave. While it might be nice to not have to work a ton of hours, that also means not getting any experience. So if in a few years the firm lets you go or you decide to leave, you’re screwed because you don’t have the experience someone your year should have. It’s a hard call to make but if it doesn’t look like it will get better, I’d jump ship unless there are other departments at your firm who could give you work that you’re interested in doing

Why do you want more work? Severely underworked big law associate as to be one of the best jobs on the planet.

Hi OP, I’ve been in the game a little while now. There are ways to stay relevant even if you’re not billing time. Read articles and learn more about the substantive area of law you practice. That’ll add vale. Everyone starts somewhere and your shot will come in time. Good luck!

Does your firm HAVE a strong appellate practice? I ask because there are numerous firms that “have” a practice but you never see or hear their names in oral args or on briefs.

like

We actually have a pretty active practice with multiple matters ongoing. I’m just not a part of any of them

Appellate litigation is still litigation, can you get some assignments from general lit at your firm until your docket fills up?

like

Agreed. Are you getting negative comments about it in reviews or anything?

Thanks A8. I feel bad complaining because I know so many people are unbelievably underworked. But it also doesn’t feel great to be utterly useless on a daily basis.

I have such a low opinion of BigLaw appellate lawyers and this post isn’t helping. You guys have such a sweet gig and you’re still managing to complain? Come onnnn! If you’re that concerned, lateral!

OP, you’re right. Like I said, it was an ass of a comment comment from my own frustration 🤷‍♂️

My firm’s IT (especially system saving and file locating function) is so bad 😐😞 and they keep doing updates no one asked them for just to mess with the stuff we already got a hang of without doing anything about the issues we actually need fixed. Or is that supposed to be our non-billable time?
