I do not qualify for FMLA - What are the chances of the firm letting me go when I take short term disability? My doctor is scheduling a surgery requiring 8 weeks of recovery. I will not have been with the firm for a year at the time of the surgery, so FMLA (job protection) does not apply to me. I am in constant pain, but I am thinking to wait until I’ve been with the firm for a year to get the surgery. I cannot afford to lose health insurance if they let me go. Thanks for your advice!

Talk to your HR. They’re, most of the time, very understanding. Even if you are not qualified for FMLA, the firm will not let you go for undergoing surgery and need time to recover.

Are you paying the premiums because you’re paid by the disability company during STD and they can’t deduct premiums from company check because you don’t get one?

What state are you at? In NYS there’s the NYPFL

Florida

They will never let you go for having surgery as it’s illegal and would open them up to a law suit.

It low they will terminate you.

I do sales for a major engineering firm. Focused on new business and exploring new markets. Last year I was in the top 50% for order intake, and first in number of projects won along with number of new customers. I think this is extraordinary given the effort it takes to win new business.
