Just learned that I'm getting laid off. Should I just sign the severance agreement? Can I argue and get more? For context, I've been with this agency for two years, and I'm getting two weeks' worth of pay.

Fellow KC resident here. Two weeks stinks but unfortunately isn’t uncommon. You can certainly try the attorney route but personally I don’t think it’s worth the cost and mental toll, especially with a tenure of two years. Wishing you the best, including finding your next gig soon!

Yeah, def aim for 3-4 week minimum plus a week or two per year served

Are you in a protected class? That usually helps with securing more.

Either way, ask for medical coverage and or more severance

The company offers severance so you’ll sign a contract agreeing not to sue them. If you have a stronger case for suing them, it’s worth more money to get you to sign.

There is no standard and there is no law requiring severance.

Worth asking for 3 or 4 weeks. Some people say it should be a week for every year you work there.

If you have only been at your agency for two years, I’d say you’re lucky to get anything whatsoever. I wouldn’t waste time or money on an employment attorney. Remember, they don’t HAVE to give you anything other than notice, and barely that. It wouldn’t hurt to ask for anything. But unless you are in a right-to-work state, they are not obligated to offer you squat.

I got two weeks for every year worked. It was a huge agency though. Couldn’t help asking for more if you really want to. But I doubt you’ll get more than 4 weeks.

You can try to get more, but I doubt very much that you will- you have no leverage whatsoever in this situation. An attorney won't help because the company isn't legally obligated to give you anything. And attorneys don't work for free.

You said that: "It's a small local agency", so be happy with the two weeks pay. Many companies won't do that. You'll be leaving under good terms, and will probably get a good reference for future employment applications.

You're under no legal obligation to sign the severance agreement. If you do, read it very carefully.

Never settle for the minimum. Make a case for yourself. Even at a small agency in Canada, I got 4 weeks for 2.5 years.

our marketing dept is undergoing a complete overhaul. under old leadership, a $75k 12-mo contract was signed to a marketing group that handles our SEO, blog and everything Google Ads.
